The civil justice system has priced itself out reach of many South Africans, and mediation is becoming more and more popular to resolve disputes in diverse fields and industries. Mediation reframes a dispute as a joint problem rather than a battle over who is going to prevail. King IV on Good Corporate Governance and 44 pieces of legislation passed by Parliament since 1994 have prepared the way for mediation to become mainstream in South Africa.
A training methodology is used that has a strong emphasis on multi-media and practical examples, illustrations and role-play, with the emphasis on South African case studies. Final role-plays will be filmed for evaluation and peer-learning purposes.

Government institutions, procurement and commercial mediation
This 60-hour course is 20 hours longer than standard mediation courses. It has been specially designed to enable attendees to become mediators and mediation advocates in mediations involving government institutions including procurement-related disputes. Delegates that qualify will also be able to mediate other commercial disputes. The program includes the recent amendments to the Court Rules pertaining to mediation. Due to the extended hours delegates are advised to stay on the Nelson Wine Estate.

Course presenters
Adv Alan Nelson SC has practised as an advocate for 40 years and was by his own admission an aggressive trial lawyer. He has acted as a judge in the Cape High Court. Alan has undergone extensive mediation training both locally and abroad at the Institute for Peace and Dialogue in Switzerland. He is an accredited CEDR mediator. Over the past nine years he has mediated a vast number of disputes in many different conflict situations including multiparty disputes. Alan frequently addresses audiences on mediation and has been a part of the UCT Law@work mediation training team for many years. Alan serves on three mediation panels and is an elected member of the ADR Forum of the Western Cape Government. Alan is the founding member of the Mediation Foundation for Peace and Justice, Mediation in Motion Not for Profit and the Nelson Peace Centre.
Oscar Siwali has worked with a range of organisations operating in the fields of conflict transformation, human rights, and election monitoring and observation in the African continent for the past twenty years. He has worked with Chapter 9 institutions such as the office of the Public Protector, national human rights institutions, various government departments as well as NGOs, the military and police. He has extensive experience in training and capacity building, facilitation, community conflict resolution, and mediation. Oscar is a peace builder and conflict transformation practitioner.
Professor Johan Walters is a retired orthopaedic surgeon and former head of the Department of Orthopaedic Surgery at UCT. He is an accredited mediator and has 35 years of experience in the preparation of medicolegal reports. He served on a preliminary committee of inquiry for the HPCSA, and is a member of the SAMLS. He has coached mediators for UCT Law@Work and Mediation in Motion Training Pty Ltd.
Daniel Nelson is a highly trained and experienced information technology specialist with international experience. Daniel is a co-founder of Mediation in Motion Training Pty Ltd and is passionate about promoting mediation, especially in the IT, business and agricultural sectors. He has played a key role in the development of MiM's innovative process that connects mediators with their prospective clients. Daniel first trained as a mediator in 2011 and in 2013 successfully completed the UCT/MiM commercial mediation course. He has since become a member of the UCT/MiM team of trainers. He is also a Harvard trained negotiator, specialising in strategic deal-making for the long term.
