Professor Tjakie Naude

Bio

Tjakie Naude is a Professor of Private Law. Her main fields of interest are the Law of Contract, including Specific Contracts, Consumer Protection and Comparative Law.

She received her BA and LLB degrees cum laude from the University of Stellenbosch, and was awarded the Hofmeyr van der Merwe medal for the graduating LLB student who performed the best in the degree programme. After qualifying as an attorney and working for a Lloyd's syndicate in Edinburgh, Scotland, she returned to Stellenbosch as a Lecturer.

Tjakie completed her doctorate on rights of first refusal (preference agreements) under the supervision of Professor Gerhard Lubbe. Part of the research for her doctorate was conducted at the Chair of Professor Reinhard Zimmermann in Regensburg, Germany, during 2001. From February to November 2006, she was a visiting fellow at the Oxford Institute of European and Comparative Law, where she undertook comparative research on unfair contract terms legislation and on standard contract terms more generally. She also undertook comparative research on the incorporation of standard terms into contracts at the Max Planck Institute for Foreign and International Private Law in Hamburg during 2006.

Her submission to Parliament on the need for an orange list of contract terms that are presumed to be unfair under the general unfairness clause in the then Consumer Protection Bill led to regulation 44 of the Consumer Protection Act Regulations of 2011. This meant that prominent prior cases on unfair contract terms such as Afrox Healthcare Bpk v Strydom 2002 (6) SA 21 (SCA) and Barkhuizen v Napier 2007 (5) SA 323 (CC), would have been decided differently had they been decided after the promulgation of regulation 44 (in the meantime financial services have been removed from the ambit of the Act).  

She joined UCT in January 2009. Together with Prof Hans Micklitz, she organised a conference on Consumer Law in Anglophone Africa in 2017. Papers presented at this conference have been published in a special issue of the 2018 Journal of Consumer Policy. She is a co-editor of the looseleaf Commentary on the Consumer Protection Act, published by Juta. Her work has been cited by the Constitutional Court, the Supreme Court of Appeal, the National Consumer Tribunal and High Courts, amongst others.
