This course offers judicial officers the opportunity to deepen their understanding of the application of international, regional, and national human rights law in judicial decision-making.
Drawing on a rich tapestry of African and global jurisprudence, it combines philosophical foundations with practical, case-based exercises to strengthen judges' ability to protect and promote human rights, thereby reinforcing constitutionalism and the rule of law.
Participants will engage with major human rights instruments, analyse complex factual scenarios, and develop robust legal reasoning for crafting effective remedies for human rights violations.
By the end of this course, participants will be able to:
Analyse the historical, philosophical, and political contexts that have shaped the development of human rights law.
Identify and apply major international, regional, and national human rights instruments in judicial decisions.
Critically assess factual and legal problems in human rights cases, including limitations on rights and admissible evidence.
Research, interpret, and master the application of human rights principles where national provisions are lacking or unclear.
Devise and craft appropriate and effective remedies for breaches of human rights.
